Buying a condo in Miami is not the same as buying a condo anywhere else in the U.S Between our coastal environment, hurricane exposure, aging buildings, and the regulatory changes that followed the Champlain Towers tragedy, condo buyers today must be far more informed, or risk costly surprises after closing.

As a Miami-based real estate advisor who works closely with both condo and single-family buyers, I spend a significant amount of time helping clients evaluate not just the unit, but the health of the building itself.

This guide breaks down what smart Miami condo buyers need to know before they purchase.

1. The Champlain Towers Effect: What Changed by Law

After the collapse of Champlain Towers South in Surfside, Florida enacted sweeping condo safety legislation designed to prevent another tragedy.

If a condominium building is three stories or higher, it is now subject to enhanced requirements, including:

  • Milestone Structural Inspections conducted by licensed engineers

  • Structural Integrity Reserve Studies (SIRS)

  • Mandatory reserve funding for structural components (no longer optional)

The Milestone Structural Inspections evaluate critical systems such as:

  • Structural load-bearing components

  • Roofs

  • Foundations

  • Waterproofing

  • Balconies

If deficiencies are found, associations may be required to:

  • Perform repairs within a defined timeline

  • Levy special assessments to fund the work

This is a major shift from the past and one that directly affects buyer risk and long-term ownership costs.

Smaller condo buildings are often perceived as “simpler” or “safer,” but that’s not always the case.

While two-story or certain three-story buildings may not be subject to the same milestone inspection timelines, they are still required to:

  • Maintain the building

  • Address structural issues

  • Comply with local building and safety codes

The difference is that issues may surface more quietly—through meeting discussions, deferred maintenance, or future assessments—rather than through mandated inspections. This makes document review even more critical.

Buyers should pay close attention to:

  • Whether reserves are fully funded or waived (where still allowed)
